Terms & Privacy

Welcome to Ather. By accessing or using our Services (the Game, website, Playtest Program, and any related tools or platforms operated by Ather Studios), you agree to be bound by these Terms of Service (ToS) and the End User License Agreement (EULA).

1. License Grant and Restrictions

Ather Studios grants you a non-exclusive, non-transferable, revocable license to use our Services for your personal, non-commercial entertainment. You may not:

• Use automation software, bots, or any unauthorized third-party program to interact with our Services.
• Attempt to reverse engineer, decompile, or disassemble any part of our Services.
• Engage in real-money trading (RMT) of in-game currency or items outside of the official Ather marketplace.

2. Ownership of Digital Assets

All in-game assets, including characters, items, and currency, remain the property of Ather Studios. However, items registered onchain represent true digital ownership to the player, subject to the EULA.

3. Playtest Program

The Playtest Program allows selected participants to access early builds of our Services. By signing up you acknowledge and agree that:

• Signing up does not guarantee selection. Participants are chosen at the sole discretion of Ather Studios.
• Roles such as Genesis or Alpha Tester may be granted to selected participants. These roles are honorary and may carry in-game benefits at launch, but grant no ownership rights or entitlements.
• Playtest access may be revoked at any time, with or without notice, for any reason.
• Playtest builds are works in progress. Features, content, and progress may change or be reset between test waves.
• Feedback, bug reports, and suggestions submitted during playtests may be used by Ather Studios to improve our Services without compensation or attribution.

4. Referral Program

Playtest participants may receive a unique referral code to share with others. The following rules apply:

• Each account is assigned one referral code. Referral credit is granted when a referred user confirms their email and completes at least one playtest task.
• Creating multiple accounts, self-referring, or using automated means to generate referrals is prohibited and may result in disqualification and account termination.
• Referral points contribute to playtest selection priority but do not guarantee access.
• Ather Studios reserves the right to modify or discontinue the referral program at any time.

5. Identity & Character Names

Character names are reserved through the .ather subdomain system on the Robinhood. By claiming a subdomain, you acknowledge and agree that:

• Ather Studios reserves the right to restrict or revoke in-game use of any name that is offensive, discriminatory, sexually explicit, impersonates another person or entity, or otherwise violates community standards.
• A restricted name remains in your wallet as a blockchain asset but cannot be used as a character name in-game.
• Subdomain purchases are non-refundable. Name restrictions do not entitle you to a refund.
• Ather Studios is the sole arbiter of what constitutes an inappropriate name and may update naming guidelines at any time.

6. Blockchain & Digital Assets

Certain features of our Services involve transactions on the Robinhood using USDC or other digital currencies. By using these features, you acknowledge and agree that:

• Blockchain transactions are irreversible. Once a transaction is confirmed onchain, it cannot be undone, reversed, or refunded by Ather Studios.
• You are solely responsible for the security of your wallet and private keys. Ather Studios does not have custody of, access to, or the ability to recover your wallet or any assets within it.
• Transaction fees (network gas fees) are determined by the Robinhood network and are outside the control of Ather Studios.
• Owning a .ather subdomain reserves your character name but does not guarantee its availability or use in the final game. Game systems, naming rules, or technical requirements may change before launch.
• Ather Studios is not liable for losses arising from failed transactions, network outages, wallet compromise, user error, or any other blockchain-related event beyond our reasonable control.

7. Conduct and Enforcement

We maintain a zero-tolerance policy for harassment, cheating, and malicious conduct. Violations may result in temporary suspension or permanent termination of your account, at the sole discretion of Ather Studios.

8. Modification of Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or website notice. Continued use of our Services constitutes acceptance of the revised terms.
